Important Information for Tobacco Seller's Licence Applicants

Any premises selling tobacco products must have a tobacco seller's licence to sell tobacco or tobacco products in Tasmania. To get a licence, send your application form plus the prescribed fee to the Director of Public Health. The prescribed fee is $191.50 per premises. It also costs $191.50 for any additional premises added to a tobacco seller's licence after the licence has been issued.

The licencee must be an individual over 18 years of age. You must ensure that a copy of a document, which proves you are over 18 years of age, unless you have previously provided proof of age to the Director of Public Health, is attached with your application. Only individuals, not companies, can apply for a tobacco seller's licence.

A tobacco seller's licence lists all the premises where the licence holder sells tobacco. An application must include a list of all the premises from where you intend to sell tobacco products.

There are penalties for selling tobacco products without a tobacco seller's licence and for selling tobacco products in premises other than those specified in the licence. The licence or a reasonable copy of the licence must be displayed on all premises where the licence holder sells tobacco or tobacco products.

The Public Health Act 1997 contains rules about selling tobacco products, including that you cannot sell tobacco products to people under 18, you cannot advertise tobacco products and that there are restrictions on display of tobacco products. It is important that all tobacco retailers familiarise themselves with the tobacco control legislation as there are penalties for breaches. A tobacco seller's licence expires at the end of the period specified in the licence or 12 months from the date of issue, whichever is sooner. If you have a licence, you will be sent an application form before your current licence expires.

Tobacco Seller's Licences are not transferable when a business changes ownership.
